Apelau yn erbyn hysbysiadau gorfodi
39.—(1) Caiff person a dramgwyddwyd gan—
(a)penderfyniad arolygydd i gyflwyno hysbysiad gorfodi; neu
(b)penderfyniad arolygydd i wrthod dyroddi hysbysiad cwblhau,
apelio yn erbyn y penderfyniad.
(2) Mae’r hawl i apelio i Dribiwnlys yr Haen Gyntaf.
(3) Ni fydd hysbysiad gorfodi yn cael ei atal dros dro tra bo apêl yn yr arfaeth, oni fydd y Tribiwnlys Haen Gyntaf yn gorchymyn yn wahanol.
(4) Yn dilyn apêl, caiff y Tribiwnlys Haen Gyntaf naill ai ddiddymu neu gadarnhau’r hysbysiad gorfodi, gydag addasiadau neu hebddynt, neu wneud pa bynnag orchymyn yr ystyria’n briodol ynghylch gwrthodiad i gyflwyno hysbysiad cwblhau.
