This Order is made in exercise of the powers conferred on the National Assembly for Wales by paragraphs 9(1) and 10(1) of Schedule 8 to the Traffic Management Act 2004(1), and now vested in the Welsh Ministers(2).

The County Council of the City and County of Cardiff has applied to the Welsh Ministers for an Order to be made under these powers with respect to part of its area.

The Welsh Ministers have consulted the chief officer of South Wales Police in accordance with the requirements of paragraph 10(4) of Schedule 8 to the Traffic Management Act 2004.

Title and commencement

1.  The title of this Order is the Civil Enforcement of Bus Lane and Moving Traffic Contraventions (City and County of Cardiff) Designation Order 2014 and it comes into force on 10 November 2014.

Designation of civil enforcement area

2.  The Welsh Ministers designate the area described in the Schedule as—

(a)a civil enforcement area for bus lane contraventions; and

(b)a civil enforcement area for moving traffic contraventions.

Article 2

SCHEDULEArea designated as a civil enforcement area

This Order applies to the whole of the city and county of Cardiff with the exception of—

(a)the M4 motorway and its slip roads and the gyratory carriageway (A4054) around Junction 32;

(b)the A470 trunk road including its northern slip roads adjoining the A4054 gyratory carriageway, from the boundary with the County Borough of Rhondda Cynon Taf at a point approximately 240 metres north of the B4262 Ynys Bridge roundabout to the M4 Junction 32 gyratory carriageway via the northern slip roads;

(c)the A48(M) from the boundary with the City of Newport administrative area to the slip road merge and diverge at the St Mellons Junction; and

(d)the A4232 from Junction 33 of the M4, including its circulatory carriageway, to its junction with the A48 gyratory at Culverhouse Cross via the northern slip roads.

EXPLANATORY NOTE

(This note is not part of the Order)

This Order designates the area described in the Schedule as a civil enforcement area for bus lane and moving traffic offences for the purposes of Part 6 of the Traffic Management Act 2004.

The practical effect of the Order is to enable the County Council of the City and County of Cardiff to enforce bus lane and moving traffic contraventions within the area described in the Schedule to the Order through a civil law regime.

The functions of the National Assembly for Wales under the Traffic Management Act 2004 were transferred to the Welsh Ministers by virtue of section 162 of, and paragraph 30 of Schedule 11 to, the Government of Wales Act 2006 (c.32). By virtue of section 92 of the Traffic Management Act 2004, the National Assembly for Wales was designated as the appropriate national authority as regards Wales, for the purposes of Part 6 of that Act.
