40.—(1) Regulation 4 is amended as follows.

(2) In paragraph (3)—

(a) in sub-paragraph (a), for the words before “has certified” substitute “the appropriate agency”;

(b) in the closing words, for the words from “provided” to “has” substitute “provided and the appropriate agency has”.
