The penalty

Period for payment of the penalty

5.  The time by which the penalty is to be paid(1) is within 42 days of receipt of the penalty notice.

If the penalty is paid within this period, the recipient cannot be convicted of the offence under section 444A(4) of the Education Act 1996 (c.56), to which the notice relates.
