Apelau
28.—(1) Caiff unrhyw berson a dramgwyddir gan benderfyniad gan Weinidogion Cymru i—
(a)amrywio, atal dros dro, dirymu neu wrthod caniatáu trwydded arolygydd cnydau, samplwr hadau, gorsaf brofi hadau, neu berson y mae arno angen trwydded o dan reoliad 20,
(b)gwrthod ardystio hadau,
(c)tynnu ardystiad hadau yn ôl,
o fewn 21 diwrnod ar ôl ei hysbysu o'r penderfyniad, apelio yn erbyn y penderfyniad, i berson a benodir at y diben gan Weinidogion Cymru.
(2) Rhaid i'r person a benodir ystyried yr apêl ac unrhyw sylwadau a wneir gan Weinidogion Cymru, a chyflwyno adroddiad ysgrifenedig i Weinidogion Cymru o fewn 21 diwrnod ynghyd ag argymhelliad ar sut i weithredu.
(3) Rhaid i Weinidogion Cymru wedyn wneud penderfyniad terfynol a hysbysu'r apelydd, ynghyd â'r rhesymau.
