The Welsh Ministers in exercise of the powers conferred upon the Secretary of State by section 21 of the Clean Air Act 1993(1) and now vested in the Welsh Ministers(2) so far as exercisable in relation to Wales, and being satisfied that the fireplaces exempted by this Order can be used for burning fuel other than authorised fuels without producing any smoke or a substantial quantity of smoke, hereby make the following Order:

Title, commencement and application

1.—(1) The title of this Order is the Smoke Control Areas (Exempted Fireplaces) (Wales) Order 2012 and it comes into force on 27 February 2012.

(2) This Order applies in relation to Wales.

Fireplaces exempted from section 20 of the Clean Air Act 1993

2.  The fireplaces described in the Schedule are, subject to the conditions listed, exempted from the provisions of section 20 of the Clean Air Act 1993 (which prohibits smoke emissions in smoke control areas).

Revocation

3.  The Smoke Control Areas (Exempted Fireplaces) (Wales) Order 2011(3) is revoked.

Fireplace	Conditions
	The fireplace must be installed, maintained and operated in accordance with the following specifications:		No fuel is to be used in the fireplace other than authorised fuels and the following fuel or fuels:
a The fuel must not contain halogenated organic compounds or heavy metals as a result of treatment with wood-preservatives or coatings.

Explanatory Note

(This note is not part of the Order)

This Order revokes and replaces with amendments the Smoke Control Areas (Exempted Fireplaces) (Wales) Order 2011 (S.I. 2011/38) (W.13).

Section 20 of the Clean Air Act 1993 (“the 1993 Act”) places a general prohibition on the emission of smoke in smoke control areas.

The Welsh Ministers may, by order made under section 21 of the 1993 Act, exempt, in relation to Wales, specified classes of fireplace from the provisions of section 20, if they are satisfied that such fireplaces can be used for burning fuel other than authorised fuels without producing any smoke or a substantial quantity of smoke.

Article 2 of this Order exempts the fireplaces listed in the first column of the Schedule to this Order from the provisions of section 20 of the 1993 Act, subject to the conditions in the second and third columns of that Schedule.

The Welsh Ministers' Code of Practice on the carrying out of Regulatory Impact Assessments was considered in relation to this Order. As a result, a regulatory impact assessment has been prepared as to the likely costs and benefits of complying with this Order. The relevant functions of the Secretary of State were, so far as exercisable in relation to Wales, transferred to the National Assembly for Wales by virtue of article 2 of, and Schedule 1 to, the National Assembly for Wales (Transfer of Functions) Order 1999 (S.I. 1999/672).
