The Welsh Ministers make the following Regulations, in exercise of the powers conferred by section 13(1) and (6) of the Social Security Act 1988(1).

Title, commencement and interpretation

1.—(1) The title of these Regulations is the Healthy Start Scheme (Description of Healthy Start Food) (Wales) (Amendment) Regulations 2011 and they come into force on 6 April 2011.

(2) In these Regulations “the principal Regulations” (“y prif Reoliadau”) means the Healthy Start Scheme (Description of Healthy Start Food) (Wales) Regulations 2006(2).

Amendment to the Schedule of the principal Regulations

2.  The Schedule to the principal Regulations is amended as follows—

(1) In column 1 (Category of food) of the table, in the third category insert “or frozen” after the word “Fresh”; and

(2) In column 2 (Qualification) of the table, substitute the third qualification with the following—

Explanatory Note

(This note is not part of the Regulations)

These Regulations amend the Healthy Start Scheme (Description of Healthy Start Food) (Wales) Regulations 2006 (“the principal Regulations”).

Regulation 2 amends the Schedule to the principal Regulations, by revising the definition of fruit and vegetables to include “frozen” fruit and vegetables and to make the qualification of that category clearer.

A full regulatory impact assessment has been undertaken in respect of these Regulations and is available from the Food and Physical Activity Branch, Welsh Assembly Government, Cathays Park, Cardiff, CF10 3NQ.

1988 c. 7. Section 13 of the Social Security Act 1988 was substituted by section 185(1) of the Health and Social Care (Community Health and Standards) Act 2003 (c. 43). By virtue of section 162 of and paragraph 30 of Schedule 11 to the Government of Wales Act 2006 (c. 32), functions conferred on the National Assembly for Wales by section 13(1) and (6) of the Social Security Act 1988 are exercisable by the Welsh Ministers.
