The Poultry Health Scheme (Fees) (Wales) Regulations 2011

Coming into force

The Welsh Ministers, with the consent of the Treasury, make these Regulations in exercise of the powers conferred by section 56(1) of the Finance Act 19731 and now vested in them.

Title, application and commencement1

The title of these Regulations is the Poultry Health Scheme (Fees) (Wales) Regulations 2011. They apply in relation to Wales and come into force on 19 October 2011.

Fees relating to the poultry health scheme2

The fee for approval for the purposes of the poultry health scheme established under paragraph 4 of Schedule 2 to the Trade in Animals and Related Products (Wales) Regulations 20112 is £60 for initial approval, with an annual fee of—

a

£62 for a flock or hatchery; or

b

£70 for a combined flock and hatchery on one site.

If the annual inspection under that paragraph is carried out by an officer of the Welsh Ministers the fee for each inspection (in addition to the annual fee) is—

a

£97 for a flock or hatchery; or

b

£143 for a combined flock and hatchery on one site.

The fee for the approval under that paragraph of a laboratory conducting diagnostic testing for members of the poultry health scheme is—

a

£13 for processing an application for approval; and

b

£31 for processing annual registration documentation.

Fee for proficiency testing a laboratory3

The fee payable by an approved laboratory for the following proficiency tests conducted by the Animal Health and Veterinary Laboratories Agency under paragraph 2 of Annex I to Council Directive 2009/158/EC (on animal health conditions governing intra-Community trade in, and imports from third countries of, poultry and hatching eggs3) is as follows.

These Regulations set the fees for approvals for the purposes of the poultry health scheme established under Council Directive 2009/158/EC of 30 November 2009 on animal health conditions governing intra-Community trade in, and imports from third countries of, poultry and hatching eggs (OJNo. L 343, 22.12.2009, p.74) and the Trade in Animals and Related Products (Wales) Regulations 2011.

A regulatory impact assessment has not been produced for this instrument as no new impact on the private, voluntary or public sectors is foreseen.
