The Travel Concessions (Eligible Services) (Amendment) Order 2010

Coming into force

In exercise of the powers conferred on them by section 94(4) of the Transport Act 19851 and section 146 of the Transport Act 20002, the Welsh Ministers make the following Order:

Title, commencement and application1

The title of this Order is the Travel Concessions (Eligible Services) (Amendment) Order 2010 and it comes into force on 1 April 2010.

This Order applies in relation to Wales.

Amendment to the Travel Concessions (Eligible Services) Order 20022

The Travel Concessions (Eligible Services) Order 20023 is amended in accordance with paragraph (2).

In article 3(1)(a)(i), for “section 509 of the Education Act 1996” substitute “sections 3, 4 and 6 of the Learner Travel (Wales) Measure 2008”.

This Order, which applies to Wales, amends the Travel Concessions (Eligible Services) Order 2002 (“the 2002 Order”).

The 2002 Order sets out what is an eligible service for the purposes of section 94 of the Transport Act 1985 and section 146 of the Transport Act 2000. Such services participate in mandatory travel concession schemes. An eligible bus service includes in specified circumstances a service provided or secured by a local authority for the purpose of learner travel.

Section 509 of the Education Act 1996 (“the Act”) placed an obligation on local education authorities in Wales to make arrangements for the provision of transport to facilitate the attendance of persons receiving education at schools and certain other institutions. Section 509 of the Act has been replaced for Wales by the Learner Travel (Wales) Measure 2008 (“the Measure”). Sections 3, 4 and 6 of the Measure now make provision as to a local authority’s functions in relation to learner travel arrangements.

This Order amends article 3(1)(a)(i) of the 2002 Order so as to refer to sections 3, 4 and 6 of the Measure instead of section 509 of the Act.
