The Welsh Ministers make the following Regulations in exercise of the powers conferred by section 2(2) of the European Communities Act 1972(1).

The Welsh Ministers have been designated for the purposes of that section in relation to measures relating to food (including drink) including the primary production of food and measures relating to feed produced for or fed to food-producing animals(2).

Title and commencement

1.  The title of these Regulations is The Rice Products from the United States of America (Restriction on First Placing on the Market) (Wales) (Revocation) Regulations 2010 and they come into force on 18 June 2010.

Revocation

2.—(1) The Rice Products from the United States of America (Restriction on First Placing on the Market) (Wales) Regulations 2008(3) are revoked.

(2) The Rice Products from the United States of America (Restriction on First Placing on the Market) (Wales) (Amendment) Regulations 2008(4) are revoked.

Explanatory Note

(This note is not part of the Regulations)

1.  These Regulations revoke the Rice Products from the United States of America (Restriction on First Placing on the Market) (Wales) Regulations 2008 (S.I. 2008/781 (W.80)) (“the principal Regulations”) together with the Rice Products from the United States of America (Restriction on First Placing on the Market) (Wales) (Amendment) Regulations 2008 (S.I. 2008/1646 (W.159)).

2.  The principal Regulations implemented in relation to Wales Commission Decision 2006/601/EC on emergency measures regarding the non-authorised genetically modified organism “LL RICE 601” in rice products (OJ No. L244, 7.9.2006, p.27) as last amended by Commission Decision 2008/162/EC amending Decision 2006/601/EC on emergency measures regarding the non-authorised genetically modified organism “LL RICE 601” in rice products (OJ No. L52, 27.2.2008, p.25). Commission Decision 2006/601/EC has been repealed by Commission Decision 2010/315/EU repealing Decision 2006/601/EC on emergency measures regarding the non-authorised genetically modified organism “LL RICE 601” in rice products, and providing for random testing for the absence of that organism in rice products (OJ No. L141, 9.6.2010, p.10).
