The Health and Social Care Act 2008 (Commencement No. 3) (Wales) Order 2010

The Welsh Ministers, in exercise of the powers conferred by sections 161(3) and (4) and 170(3) of the Health and Social Care Act 20081 make the following Order:

Title and application1

The title of this Order is the Health and Social Care Act 2008 (Commencement No 3) (Wales) Order 2010.

This Order applies in relation to Wales.

Appointed day2

21 May 2010 is the appointed day for the coming into force of the following provisions of the Health and Social Care Act 2008—

a

section 140, in so far as it relates to Part 2 of Schedule 12;

b

section 166, in so far as it relates to the repeals mentioned in paragraph (d);

c

Part 2 of Schedule 12; and

d

the repeals included in Part 4 of Schedule 15 that relate to sections 174 to 176 of, and Schedule 8 to, the National Health Service (Wales) Act 20062.

This Order brings into force on 21 May 2010 provisions of the Health and Social Care Act 2008 (“the Act”) relating to the funding of expenditure on community pharmaceutical services provided as part of the National Health Service in Wales. The principal changes are: firstly, that funding for community pharmaceutical services that previously had been held centrally will become part of the allocations given to Local Health Boards; and secondly, the Welsh Ministers are given powers to designate any element of the remuneration paid by Local Health Boards for community pharmaceutical services which is not referable to the cost of drugs. Designation is a mechanism which allows the Welsh Ministers to control the way the funding of a designated element is apportioned between Local Health Boards.

The following provisions of the Act have been brought into force in relation to Wales by commencement orders made by the Welsh Ministers before the date of this Order.
