The Welsh Ministers make the following Regulations in exercise of the powers conferred on the Secretary of State by sections 20(2) and 21(1) of, and Schedule 4 to, the Further and Higher Education Act 1992(1) (“the Act”) and now exercisable by them(2).

1992 c. 13; section 21(1) was amended by section 140 of and paragraph 35 of Schedule 30 to and Schedule 31 to the School Standards and Framework Act 1998 (c. 31). Paragraph 1A of Schedule 4 was inserted by section 146 of, and paragraphs 1 and 44(1) and (2) of Schedule 9 to, the Learning and Skills Act 2000 (c. 21). Paragraph 1A of Schedule 4 was amended by article 9(1) of and paragraphs 13 and 28 of Schedule 1 to the National Council for Education and Training for Wales (Transfer of Functions and Abolition) Order 2005 (S.I. 2005/3238) (W. 243). Paragraph 5 of Schedule 4 was amended by section 149 and paragraphs 1 and 44 of Schedule 9 to the Learning and Skills Act 2000. See section 61(1) of the Further and Higher Education Act 1992 for the meaning of “regulations”.

The functions of the Secretary of State under sections 20(2) and 21(1) of, and Schedule 4 to, the Further and Higher Education Act 1992 were (so far as exercisable in relation to Wales) transferred to the National Assembly for Wales, by article 2 of, and Schedule 1 to, the National Assembly for Wales (Transfer of Functions) Order 1999 (S.I. 1999/672). The functions of the National Assembly for Wales were then transferred to the Welsh Ministers by virtue of paragraphs 30(1) and 30(2)(a) of Schedule 11 to the Government of Wales Act 2006 (c. 32).
