RHAN 1Apelau os nad Gweinidogion Cymru yw'r awdurdod gorfodi

1.  Mae'r Rhan hon yn gymwys os nad Gweinidogion Cymru yw'r awdurdod gorfodi.

2.  Rhaid i hysbysiad o apêl gynnwys—

(a)copi o'r hysbysiad neu'r hysbysiad adfer yr apelir yn ei erbyn; a

(b)seiliau'r apêl.

3.  Pan ddaw hysbysiad i law, rhaid i Weinidogion Cymru anfon copi o'r hysbysiad am apêl i'r awdurdod gorfodi, a rhaid i'r awdurdod gorfodi anfon copi ar unwaith at unrhyw berson y mae'n ymddangos i'r awdurdod gorfodi fod ganddo fuddiant arbennig ym mhwnc yr apêl, a hysbysu Gweinidogion Cymru o bwy y mae wedi'i hysbysu.

4.  Rhaid i Weinidogion Cymru hysbysu'r apelydd o'r terfyn amser erbyn pryd y mae'n rhaid i'r apelydd ddarparu mewn ysgrifen—

(a)datganiad o achos; a

(b)pob gohebiaeth berthnasol.

5.  Pan ddaw'r rhain i law, rhaid i Weinidogion Cymru anfon yr holl ddogfennau i'r awdurdod gorfodi, gan roi i'r awdurdod gorfodi derfyn amser erbyn pryd y mae'n rhaid iddo roi ymateb ysgrifenedig.

6.  Rhaid i Weinidogion Cymru hysbysu'r un pryd unrhyw berson a hysbyswyd o dan baragraff 3 o'r terfyn amser o dan baragraff 5 a'i wahodd i gyflwyno sylwadau erbyn y dyddiad hwnnw.

7.  Rhaid i Weinidogion Cymru benderfynu wedyn a oes angen tystiolaeth bellach, a rhoi cyfarwyddiadau'n unol â hynny.

8.  Rhaid i Weinidogion Cymru gyfeirio'r apêl wedyn i berson a benodwyd ganddynt i ymdrin â'r apêl, gan ddatgan wrth y person penodedig a oes rhaid ymdrin â'r apêl drwy weithdrefn ysgrifenedig ai peidio ynteu a oes rhaid cynnal gwrandawiad.

9.  Ar ôl i'r apêl gael ei chwblhau gan y person penodedig, rhaid iddo benderfynu'r mater neu, os caiff ei gyfarwyddo gan Weinidogion Cymru ar unrhyw bryd cyn bod y penderfyniad wedi'i wneud, gyflwyno argymhelliad i Weinidogion Cymru, a rhaid i Weinidogion Cymru benderfynu'r apêl.

10.  Caiff y person sy'n penderfynu'r apêl wneud unrhyw orchymyn ynghylch costau'r partïon (gan gynnwys partïon sy'n cyflwyno sylwadau) y gwêl yn dda.
