Apelio yn erbyn yr hysbysiad adfer

21.—(1) Caiff y gweithredwr cyfrifol hysbysu Gweinidogion Cymru fod y person hwnnw'n bwriadu apelio yn erbyn yr hysbysiad adfer ar y sail bod cynnwys yr hysbysiad hwnnw'n afresymol.

(2) Dim ond yn erbyn y rhannau hynny o'r hysbysiad adfer sy'n wahanol i'r cynigion a wnaed gan y gweithredwr cyfrifol y caniateir i apêl gael ei dwyn.

(3) Rhaid i hysbysiad o apêl gael ei gyflwyno i Weinidogion Cymru o fewn 28 niwrnod i ddyddiad cyflwyno'r hysbysiad adfer oni chaiff y terfyn amser gael ei estyn gan Weinidogion Cymru.

(4) Mae Atodlen 5 yn cynnwys gweithdrefnau ar gyfer yr apêl.

(5) Caiff Gweinidogion Cymru neu'r person penodedig gadarnhau, amrywio neu ddiddymu'r hysbysiad, a rhaid i'r Gweinidogion neu'r person hwnnw roi hysbysiad ysgrifenedig o'r penderfyniad terfynol a'r rhesymau drosto, a chaniateir iddynt neu iddo ychwanegu, os yw'n briodol, gofynion adfer cydadferol pellach y mae'r treiglad amser ers i'r hysbysiad adfer gael ei gyflwyno yn eu gwneud yn angenrheidiol.

(6) Nid oes angen cydymffurfio â hysbysiad adfer tra'n aros i apêl gael ei phenderfynu onid yw'r person sy'n gwrando'r apêl yn cyfarwyddo fel arall.
