Coming into force in accordance with article 1
The Local Government Boundary Commission for Wales, having submitted to the Welsh Ministers, in accordance with sections 54(1) and 58(1) of the Local Government Act 1972(1), a report dated July 2008 on a review of part of the boundary between the County of Powys and the County Borough of Merthyr Tydfil, together with the proposals formulated by the Commission thereon;
And the Welsh Ministers having decided to give effect to these proposals without modification;
And more than six weeks having elapsed since these proposals were submitted to the Welsh Ministers;
The Welsh Ministers, in exercise of the powers conferred on the Secretary of State by section 58(2) and (4)(a) of the Local Government Act 1972 and now vested in them so far as exercisable in relation to Wales(2), make the following Order:
1.—(1) The title of this Order is the Merthyr Tydfil and Powys (Areas) Order 2009.
(2) For any purpose set out in regulation 4(1) of the Regulations, this Order comes into operation on 1 May 2009.
(3) For all other purposes, this Order comes into force on 1 June 2009, which is the appointed day for the purposes of the Regulations.
2. In this Order—
“the boundary map” (“y map ffiniau”) means the map marked “Map of the Merthyr Tydfil and Powys (Areas) Order 2009”, deposited in accordance with regulation 5 of the Regulations;
“the Regulations” (“y Rheoliadau”) means the Local Government Area Changes Regulations 1976(3).
3. That part of the county of Powys falling within the community of Talybont-on-Usk and shown as hatched area “A” on the boundary map—
(a)is transferred to the county borough of Merthyr Tydfil;
(b)forms part of the community of Vaynor; and
(c)forms part of the electoral division of Vaynor.
4. That part of the community of Talybont-on-Usk in the county of Powys shown as hatched area “B” on the boundary map—
(a)is transferred to the community of Llangynidr; and
(b)forms part of the electoral division of Llangynidr.

This Order, made in accordance with section 58(2) and (4)(a) of the Local Government Act 1972, gives effect to proposals by the Local Government Boundary Commission for Wales (“the Commission”) which reported in July 2008 on its review of part of the boundary between the county of Powys and the county borough of Merthyr Tydfil in the area of Pontsticill. The Commission report recommended a change to part of the existing boundary and also recommended a change to the boundary between the communities of Talybont-on-Usk and Llangynidr. This Order gives effect to the Commission’s recommendations without modification.
A print of the map showing the boundaries is deposited and may be inspected during normal office hours at the offices of Powys County Council, Llandrindod Wells, Powys, at the offices of Merthyr Tydfil County Borough Council, Merthyr Tydfil, and at the offices of the Welsh Assembly Government at Cathays Park, Cardiff (Local Government Policy Division).
The Local Government Area Changes Regulations 1976 referred to in articles 1 and 2 of this Order contain incidental, consequential, transitional and supplementary provision about the effect and implementation of orders such as this.
The powers of the Secretary of State were transferred to the National Assembly for Wales by the National Assembly for Wales (Transfer of Functions) Order 1999 (S.I. 1999/672) and are now vested in the Welsh Ministers by virtue of paragraph 30 of Schedule 11 to the Government of Wales Act 2006 (c. 32).
