Explanatory Note

(This note is not part of the Order)

The Education (Recognised Bodies) (Wales) Order 2007 (“the 2007 Order”) lists all the bodies appearing to the Welsh Ministers to be recognised bodies within section 214 (2) (a) or (b) of the Education Reform Act 1988 (“the 1988 Act”). Such bodies are either:

(a)universities, colleges or bodies authorised by Royal Charter or by or under an Act of Parliament to grant degrees; or

(b)bodies which are for the time being permitted by any body falling within paragraph (a) to act on its behalf in the granting of degrees.

The Order amends the 2007 Order and updates the list of bodies contained in the schedule to that Order. A number of bodies are omitted from the Schedule as they no longer have degree awarding powers or have merged with other bodies. A number of new bodies have been inserted into the Schedule as these bodies now appear to the Welsh Ministers to fall within either (a) or (b) above. A number of minor amendments have also been made to the Schedule to take account of name changes since the 2007 Order was made.

(2)

By virtue of the National Assembly for Wales (Transfer of Functions) Order 1999 (S.I. 1999/672) and paragraph 30(1) and (2)(a) of Schedule 11 to the Government of Wales Act 2006.
