The Welsh Ministers, in exercise of the powers conferred upon them by section 262(2) and (3) of the Apprenticeships, Skills, Children and Learning Act 2009(1), make the following Order:

Title and interpretation

1.—(1) The title of this Order is the Apprenticeships, Skills, Children and Learning Act 2009 (Commencement No. 1) (Wales) Order 2009.

(2) In this Order “the 2009 Act” (“Deddf 2009”) means the Apprenticeships, Skills, Children and Learning Act 2009.

Appointed day

2.  Section 205 of, and Schedule 14 to, the 2009 Act come into force on 12 January 2010 in relation to Wales.

Explanatory Note

(This note is not part of the Order)

This is the first commencement order made by the Welsh Ministers under the Apprenticeships, Skills, Children and Learning Act 2009 (c. 22) (“the 2009 Act”).

The Order brings into force on 12 January 2010 section 205 of, and Schedule 14 to, the 2009 Act.

Section 205 of, and Schedule 14 to, the 2009 Act make provision in relation to schools causing concern in Wales and to the enforcement by local education authorities of teachers' pay and conditions. In particular paragraph 6 of Schedule 14 to the 2009 Act inserts a new section 19ZA into the School Standards and Framework Act 1998 (c. 31), which gives a power to the Welsh Ministers to direct local education authorities to give a warning notice to a governing body of a maintained school in connection with an order under section 122 of the Education Act 2002 (teachers' pay and conditions).
