Dethol gan y corff goruchwylio

11.—(1) Mae'r rheoliad hwn yn gymwys pan nad oes person wedi'i ddethol yn unol â rheoliadau 7(2), 8(2) neu 10(2).

(2) Rhaid i'r corff goruchwylio ddethol person i'w benodi yn gynrychiolydd i'r person perthnasol.

(3) Os bydd person a ddetholir yn unol â pharagraff (2) yn gweithredu mewn swyddogaeth broffesiynol

(a)rhaid i'r person hwnnw fod â'r hyfforddiant a'r profiad priodol, a

(b)rhaid bod y corff goruchwylio wedi'i fodloni bod y canlynol ar gael mewn perthynas â'r person hwnnw—

(i)tystysgrif cofnod troseddol fanwl a ddyroddir yn unol ag adran 113B o Ddeddf yr Heddlu 1997(1); neu

(ii)os nad yw'r diben y mae'r dystysgrif yn ofynnol ati yn un a ragnodir o dan is-adran (2) o'r adran honno, tystysgrif cofnod troseddol a ddyroddir yn unol ag adran 113A o'r Ddeddf honno.

(4) At ddibenion paragraff (3), person sy'n gweithredu mewn swyddogaeth broffesiynol yw person a gafodd ei ddethol gan yr asesydd lles pennaf neu gan y corff goruchwylio a hwnnw'n berson nad yw'n aelod o'r teulu, yn gyfaill nac yn ofalwr i'r person perthnasol.
