RHAN 2Swyddogaethau goruchwylio

Swyddogaethau goruchwylio sy'n arferadwy gan Fyrddau Iechyd Lleol

3.—(1) Bydd pob Bwrdd Iechyd Lleol yn arfer swyddogaethau goruchwylio—

(a)mewn perthynas ag unrhyw berson sydd â lle ganddo mewn ysbyty neu sy'n debygol o gael lle mewn ysbyty (p'un a ydynt yn ysbytai'r GIG neu'n ysbytai annibynnol) yn ei ardal er mwyn derbyn gofal perthnasol neu driniaeth berthnasol(1); a

(b)os bydd y Bwrdd Iechyd Lleol yn comisiynu gofal perthnasol neu driniaeth berthnasol i berson mewn ysbyty (p'un ai ysbyty'r GIG neu ysbyty annibynnol) yn Lloegr mewn perthynas â'r ysbyty hwnnw.

(2) Os bydd Gweinidogion Cymru yn comisiynu gofal perthnasol neu driniaeth berthnasol i unrhyw berson sydd â lle ganddo mewn ysbyty neu sy'n debygol o gael lle mewn ysbyty (p'un ai ysbyty'r GIG neu ysbyty annibynnol) yn Lloegr y corff goruchwylio fydd y Bwrdd Iechyd Lleol ar gyfer yr ardal y mae'r person fel arfer yn byw ynddi.

(3) Yn ddarostyngedig i unrhyw gyfarwyddiadau a roddir gan Weinidogion Cymru, mae modd i swyddogaethau goruchwylio sy'n arferadwy gan Fwrdd Iechyd Lleol, drwy drefniant â'r Bwrdd hwnnw, ac yn ddarostyngedig i'r fath gyfyngiadau ac amodau ag y tybia'r Bwrdd hwnnw eu bod yn briodol, gael eu harfer—

(a)ar ran y Bwrdd hwnnw gan bwyllgor, is-bwyllgor neu swyddog o'r Bwrdd;

(b)ar y cyd â Bwrdd Iechyd Lleol arall;

(4) Mae i “swyddogaethau goruchwylio” yr un ystyr ag sydd i “supervisory functions” ym mharagraff 165(3) o Atodlen A1 i'r Ddeddf.

Diffinnir “relevant care or treatment” ym mharagraff 7 o Atodlen A1 i'r Ddeddf.
