The Welsh Ministers in exercise of the powers conferred on them by sections 3(4), (5) and (6) and 8 of the Health (Wales) Act 2003(1), make the following Order—

Title, commencement and application

1.—(1) The title of this Order is the Wales Centre for Health (Transfer of Functions, Property, Rights and Liabilities and Abolition) (Wales) Order 2009 and it comes into force on 1 October 2009.

(2) This Order applies to Wales.

Interpretation

2.  In this Order—

  • “the 2003 Act” (“Deddf 2003”) means the Health (Wales) Act 2003;

  • “transfer date” (“dyddiad trosglwyddo”) means 1 October 2009;

  • “Wales Centre for Health” (“Canolfan Iechyd Cymru”) means the body known as Wales Centre for Health established by section 2 of the Health (Wales) Act 2003.

Transfer of the functions of the Wales Centre for Health to the Welsh Ministers

3.  With effect from the transfer date, all the functions of the Wales Centre for Health, as set out in section 3 of the 2003 Act, are transferred to the Welsh Ministers.

Transfer of property

4.  With effect from the transfer date, all property of the Wales Centre for Health will transfer to the Welsh Ministers, including the property listed in Schedule 1.

Enforceability of rights and transfer of liabilities

5.—(1) Any right that was immediately before the transfer date enforceable by or against the Wales Centre for Health is transferred to the Welsh Ministers.

(2) Any liability arising from the exercise of its functions that was, immediately before the transfer date, enforceable against the Wales Centre for Health is transferred to the Welsh Ministers.

Abolition of the Wales Centre for Health

6.  The Wales Centre for Health is abolished with effect from 1 October 2009.

Consequential revocation of the Wales Centre for Health (Constitution, Membership and Procedures) Regulations 2004

7.  The Wales Centre for Health (Constitution, Membership and Procedures) Regulations 2004(2) are revoked with effect from the transfer date.

Explanatory Note

(This note is not part of the Order)

This Order abolishes on 1 October 2009 the body known as the Wales Centre for Health established under section 2 of the Health (Wales) Act 2003.

This Order revokes the Order specified in article 7 and makes provision for the transfer of functions (article 3); property (article 4) and rights and liabilities (article 5) to the Welsh Ministers.
