The Welsh Ministers in exercise of the powers conferred on the Secretary of State by sections 94(5A), 95(3A) and 138(7) and (8) of the School Standards and Framework Act 1998(1) and now vested in them(2), and after consultation with the Administrative Justice and Tribunals Council in accordance with Schedule 7 to the Tribunals, Courts and Enforcement Act 2007(3), make the following Regulations.

Title, Commencement and Application

1.—(1) The title of these Regulations is the Education (Admission Appeals Arrangements) (Wales) (Amendment No. 2) Regulations 2009, and they come into force on 15 July 2009.

(2) These Regulations apply in relation to Wales.

Amendment of Regulations

2.—(1) The Education (Admission Appeals Arrangements) (Wales) Regulations 2005(4) are amended as follows.

(2) In Schedule 2 to the Regulations, in each place it occurs, replace—

  • “local authority” with “local education authority”.

Explanatory Note

(This note is not part of the Regulations)

These Regulations amend the Education (Admission Appeals Arrangements) (Wales) Regulations 2005 S.I. 2005/1398 (W.112) (“the 2005 Regulations”) and come into force on 15 July 2009. The amendment in regulation 2 makes a minor technical change to the 2005 Regulations and replaces the words “local authority” in Schedule 2 with “local education authority”.

1998 c. 31. Sub-section 5A was inserted into section 94 by section 50 of the Education Act 2002 (c. 32). Sub-section 3A was inserted into section 95 by paragraph 9 of Schedule 4 to the Education Act 2002 (c. 32).

The functions of the Secretary of State under these sections were transferred to the National Assembly for Wales by the National Assembly for Wales (Transfer of Functions) Order 1999 (S.I. 1999/672) and then to the Welsh Ministers by paragraph 30 of Schedule 11 to the Government of Wales Act 2006 (c. 32).

2007 c. 15. Paragraph 24(1) of Schedule 7 to the Tribunals, Courts and Enforcement Act 2007 directs that the power of the Welsh Ministers to make, approve, confirm or concur in procedural rules for any listed tribunal is exercisable only after consultation with the Council.
