Rheoliadau Deunyddiau ac Eitemau Plastig mewn Cyffyrddiad â Bwyd (Cymru) (Rhif 2) 2008

RHAN 1Rheolau Sylfaenol

1.  Yn ddarostyngedig i baragraffau 2, 3 a 4 o'r Rhan hon, rhaid gwneud profion ymfudiad i benderfynu ymfudiad penodol a chyflawn drwy ddefnyddio'r efelychwyr bwyd a bennir yn Rhannau 2, 3 a, phan fo hynny'n briodol 4, ac o dan amodau prawf ymfudiad confensiynol fel a bennir yn Rhan 5.

2.  Yn ddarostyngedig i baragraffau 3 a 4 o'r Rhan hon, rhaid gwneud profion disodli sy'n defnyddio cyfryngau prawf o dan yr amodau profion disodli confensiynol fel a bennir yn Rhan 6 os nad yw'r prawf ymfudiad sy'n defnyddio'r efelychwyr bwyd brasterog a bennir yn Rhan 3 yn bosibl am resymau technegol sy'n gysylltiedig â'r dull dadansoddi.

3.  Yn ddarostyngedig i baragraff 4 o'r Rhan hon, caniateir defnyddio profion amgen fel a bennir yn Rhan 7 yn lle'r prawf ymfudiad gydag efelychwyr bwyd brasterog a bennir yn Rhan 3 ond ni chaniateir defnyddio canlyniadau'r cyfryw brofion amgen i benderfynu cydymffurfedd â therfyn ymfudiad oni chyflawnir yr amodau a bennir yn Rhan 7.

4.  Mewn profion ymfudiad caniateir—

(a)gostwng nifer y profion sydd i'w gwneud gan ddefnyddio dim ond y prawf hwnnw neu'r profion hynny y cydnabyddir yn gyffredinol mai ef neu hwy, yn yr achos penodol o dan sylw, yw'r rhai mwyaf heriol ar sail tystiolaeth wyddonol;

(b)hepgor y profion ymfudiad, y profion disodli neu'r profion amgen —

(i)os bod prawf digamsyniol na ellir mynd dros ben y terfynau ymfudiad o dan unrhyw amodau y gellir eu rhagweld o ran defnyddio'r deunydd neu'r eitem, neu

(ii)os bodlonir yr amodau ar gyfer profion nad ydynt yn orfodol a geir yn Erthygl 8(2) neu 8(3) o'r Gyfarwyddeb.
