Amddiffyniad trosiannol o ran gasgedi PVC sy'n cynnwys olew ffa soia wedi'i epocsideiddio

21.—(1) Mewn unrhyw achos am dramgwydd o dan reoliad 3 ynghylch gwerthu jar wydr—

(a)sy'n cynnwys

(i)fformiwla babanod neu fformiwla ddilynol fel y'u diffinnir gan Gyfarwyddeb y Comisiwn 2006/141/EC(1), neu

(ii)bwydydd neu fwydydd babanod wedi'u seilio ar rawn ac wedi'u prosesu ar gyfer babanod a phlant bach fel y'u diffinnir gan Gyfarwyddeb y Comisiwn 2006/125/EC(2), a

(b)y selir ei chaead drwy gyfrwng gasged PVC sy'n cynnwys olew ffa soia wedi'i epocsideiddio ac iddo'r Rhif PM/Ref 88640 yn Adran A o Atodiad III,

mae'n amddiffyniad i brofi'r materion a nodir ym mharagraff (2).

(2) Y materion i'w profi yw'r canlynol —

(a)yr oedd y gasged PVC a grybwyllir ym mharagraff (1)(b) yn cydymffurfio â'r cyfyngiadau a'r manylebau perthnasol yng ngholofn 4 yn Eitem 259A yn Rhan 1 o Atodlen 2 i Reoliadau Deunyddiau ac Eitemau Plastig mewn Cysylltiad â Bwyd (Cymru) 2006(3);

(b)llanwyd a seliwyd y jar wydr cyn 19 Tachwedd 2006;

(c)yr oedd dyddiad llenwi neu ddangosiad mewn cod o'r dyddiad hwnnw yn bresennol ar y jar neu ar ei chaead adeg y gwerthiant; ac

(ch)yr oedd y labelu neu'r marcio â'r manylion a grybwyllir yn is-baragraff (c) adeg y gwerthiant yn cydymffurfio â'r gofynion sy'n ymwneud â hirbarhad yn Erthygl 2(1)(a) o Gyfarwyddeb 2000/13/EC Senedd Ewrop a'r Cyngor(4).

(3) Ni chaiff neb, heb esgus rhesymol, fethu â chydymffurfio â gofyniad a wnaed gan yr awdurdod gorfodi i ddatgelu'r dyddiad a arwyddoceir gan y dangosiad mewn cod a grybwyllir ym mharagraff (2)(c).
