Title, commencement and interpretation

1.—(1) The title of this Order is the North Wales National Health Service Trust (Establishment) Order 2008 and it comes into force on 25 June 2008.

(2) In this Order unless the context otherwise requires —

“the Act” (“y Ddeddf”) means the National Health Service (Wales) Act 2006;

“community health services” (“gwasanaethau iechyd cymunedol”) means any service which the Welsh Ministers may provide under section 3(1) of or Schedule 1 to the Act;

“establishment date” (“dyddiad sefydlu”) means 25 June 2008;

“operational date” has the meaning assigned to it in paragraph 5(5) of Schedule 3 to the Act;

“the trust” (“yr ymddiriedolaeth”) means the North Wales National Health Service Trust established by article 2 of this Order.

Establishment of the trust

2.  There is hereby established a National Health Service trust which is called the North Wales National Health Service Trust or Ymddiriedolaeth Gwasanaeth Iechyd Gwladol Gogledd Cymru.

Nature and functions of the trust

3.—(1) The trust is established for the purposes specified in section 18(1) of the Act.

(2) The trust’s functions are to provide goods and services (including hospital accommodation and community health services) from

(a)Glan Clwyd Hospital, Rhyl, Denbighshire, LL18 5UJ; and

(b)Wrexham Maelor Hospital, Croesnewydd Road, Wrexham, LL13 7TD

and associated hospitals and premises.

Directors of the Trust

4.—(1) The trust will have, in addition to the chairman, 7 non-executive directors and 5 executive directors.

(2) Since the trust is to be regarded as having a significant teaching commitment within the meaning of paragraph 5(3) of Schedule 3 to the Act, one of the non-executive directors is to be appointed from Cardiff University.

Operational date and accounting date of the trust

5.—(1) The operational date of the trust shall be 1 July 2008.

(2) The accounting date of the trust shall be 31 March.

Limited functions before operational date

6.  Between its establishment date and its operational date the trust has the functions—

(a)of entering into NHS contracts

(b)of entering into other contracts including contracts of employment; and

(c)of doing such other things as are reasonably necessary to enable it to begin to operate satisfactorily with effect from its operational date.
