Mae Gweinidogion Cymru drwy arfer y pwerau a roddwyd i Gynulliad Cenedlaethol Cymru gan adrannau 105(4) a (5) a 210 o Ddeddf Addysg 2002(1) ac sydd bellach wedi'u breinio ynddynt hwy(2) yn gwneud y Gorchymyn canlynol:

Enwi, cychwyn a chymhwyso

1.—(1) Enw'r Gorchymyn hwn yw Gorchymyn Addysg (Y Cwricwlwm Cenedlaethol) (Ieithoedd Tramor Modern) (Cymru) 2008 a daw i rym ar 1 Awst 2008.

(2) Mae'r Gorchymyn hwn yn gymwys o ran Cymru.

Dirymu

2.  Dirymir Gorchymyn Addysg (Y Cwricwlwm Cenedlaethol) (Ieithoedd Tramor Modern) (Cymru) 2000(3).

Ystyr iaith dramor fodern

3.  At ddibenion adran 105 o Ddeddf Addysg 2002 ystyr “iaith dramor fodern” yw unrhyw iaith dramor fodern.

Penderfyniad gan Weinidogion Cymru

4.—(1) Mae unrhyw gwestiwn ynghylch a yw iaith dramor benodol yn iaith dramor fodern at ddibenion adran 105 o Ddeddf Addysg 2002 i'w benderfynu gan Weinidogion Cymru.

(2) Caiff Gweinidogion Cymru wneud dyfarniad o dan baragraff (1) yn sgil cais gan unrhyw berson neu o'u hysgogiad eu hunain.

Nodyn Esboniadol

(Nid yw'r nodyn hwn yn rhan o'r Gorchymyn)

Mae “iaith dramor fodern” yn bwnc sylfaen yn y Cwricwlwm Cenedlaethol yng Nghymru yn y trydydd cyfnod allweddol. Mae'n ofynnol i'r ieithoedd hynny sydd i'w cyfrif yn ieithoedd modern at ddibenion y Cwricwlwm Cenedlaethol gael eu pennu mewn Gorchymyn a wneir gan Weinidogion Cymru, neu, fel arall, caiff Gorchymyn o'r fath ddarparu bod unrhyw iaith dramor fodern yn iaith dramor fodern at y cyfryw ddibenion. Mae'r Gorchymyn hwn yn darparu bod unrhyw iaith dramor fodern yn iaith dramor fodern, a bod unrhyw gwestiwn ynghylch a yw iaith dramor yn iaith dramor fodern i'w benderfynu gan Weinidogion Cymru.

Cafodd swyddogaethau Cynulliad Cenedlaethol Cymru o dan yr adrannau hyn eu trosglwyddo i Weinidogion Cymru o dan baragraff 30 o Atodlen 11 i Deddf Llywodraeth Cymru 2006 (p.32).
