Hysbysiadau gwella

7.—(1) Os yw arolygydd yn barnu bod person—

(a)yn cyflawni unrhyw weithgaredd sy'n torri un neu ragor o amodau trwydded a ddyroddwyd o dan y Gorchymyn hwn, neu

(b)wedi torri un neu ragor o'r amodau hynny mewn amgylchiadau sy'n ei gwneud yn debygol y bydd y toramod yn parhau neu'n cael ei ailadrodd,

caiff yr arolygydd hwnnw gyflwyno hysbysiad (“hysbysiad gwella”) i'r person hwnnw.

(2) Rhaid i hysbysiad gwella—

(a)pennu amodau'r drwydded a dorrwyd;

(b)esbonio'r rhesymau paham y mae'r arolygydd o'r farn honno; ac

(c)ei gwneud yn ofynnol i'r person hwnnw unioni'r toramod neu'r materion sydd yn ei achosi, cyn pen y cyfnod a gaiff ei bennu yn yr hysbysiad.

(3) Rhaid i hysbysiad gynnwys cyfarwyddiadau ynghylch y mesurau i'w cymryd i unioni unrhyw doramod neu fater y mae a wnelo'r hysbysiad ag ef; a chaniateir llunio'r cyfryw gyfarwyddiadau mewn dull sy'n rhoi dewis i'r person y cyflwynir yr hysbysiad iddo rhwng ffyrdd gwahanol o unioni'r toramod neu'r mater.
