Hollti dros dro hawl comin
2.—(1) Caniateir i hawl comin i bori anifeiliaid y mae adran 9(1) o Ddeddf Tiroedd Comin 2006 yn gymwys iddi gael ei hollti dros dro oddi wrth y tir y mae'r hawl honno'n gysylltiedig ag ef drwy brydlesu neu drwyddedu—
(a)yr hawl comin ar ei phen ei hun, ar yr amod na fydd cyfnod y brydles neu'r drwydded yn hwy na thair blynedd; neu
(b)y tir, neu ran o'r tir, y mae'r hawl comin yn gysylltiedig ag ef, heb yr hawl comin.
(2) Pan fo hawl comin wedi'i hollti dros dro oddi wrth unrhyw dir yn unol â pharagraff (1)(b), ni fydd unrhyw effaith i unrhyw warediad o'r hawl comin a gedwir lle bo'r gwarediad yn cymryd lle adeg rhoi neu ar ôl rhoi'r brydles neu'r drwydded ar y tir, a chyn i'r brydles neu'r drwydded gael ei therfynu oni fydd yn cael ei gwaredu—
(a)i grantî'r brydles neu'r drwydded ar y tir; ac
(b)am gyfnod sy'n dod i ben ddim mwy na thair blynedd ar ôl i'r brydles neu'r drwydded honno ddod i ben.
(3) Mae cyfeiriadau yn yr erthygl hon at hawl comin, mewn perthynas â hawl comin i bori mwy nag un anifail, yn cynnwys hawl i bori cyfran o nifer yr anifeiliaid y caniateir eu pori yn rhinwedd yr hawl comin honno.
