Gwaredu cynhyrchion tramwy a ddychwelwyd
43.—(1) Os bydd cynnyrch tramwy yn cael ei ddychwelyd i Gymru ar ôl ymadael â thiriogaeth dollau'r Gymuned, rhaid i'r person sy'n gyfrifol dros y cynnyrch tramwy naill ai—
(a)anfon ymlaen y cynnyrch tramwy o'r safle arolygu ar y ffin y mae'n cael ei ddychwelyd i drydedd wlad drwyddo drwy'r dull cludo a ddefnyddiwyd i'w ddychwelyd a hynny o fewn trigain o ddiwrnodau iddo gael ei ddychwelyd (heb gynnwys y dyddiad y cafodd ei ddychwelyd); neu
(b)os yw'r amgylchiadau a ddisgrifir ym mharagraff (2) yn gymwys, gwaredu'r cynnyrch fel pe bai'n ddeunydd Categori 1 o dan Reoliad (EC) Rhif 1774/2002 yn y cyfleusterau a ddarparwyd at y diben hwnnw ac sydd agosaf at y safle arolygu ar y ffin y dychwelir y cynnyrch iddo.
(2) Rhaid gwaredu'r cynnyrch tramwy yn unol â pharagraff (1)(b)—
(c)pan fydd anfon y cynnyrch ymlaen wedi'i ragwahardd ar sail iechyd anifeiliaid neu iechyd y cyhoedd oherwydd canlyniadau gwiriad ffisegol, neu oherwydd unrhyw ofyniad iechyd anifeiliaid neu iechyd y cyhoedd sydd wedi'i osod mewn offeryn Cymunedol sydd mewn grym ar y dyddiad y gwneir y Rheoliadau hyn, neu pan fydd yn amhosibl gwneud fel arall;
(d)pan fydd y cyfnod o drigain o ddiwrnodau y cyfeirir ato ym mharagraff (a) wedi dod i ben; neu
(e)pan fydd y person sy'n gyfrifol dros y cynnyrch tramwy yn cytuno ar unwaith i'w waredu.
(3) Rhaid i unrhyw berson, y mae ganddo yn ei feddiant neu o dan ei reolaeth y dogfennau gofynnol neu'r ddogfen fynediad filfeddygol gyffredin sy'n ymwneud â chynnyrch tramwy y mae paragraff (1) yn gymwys iddo, eu cyflwyno i'w hannilysu i'r milfeddyg swyddogol wrth y safle arolygu ar y ffin y mae'r cynnyrch wedi'i ddychwelyd iddo.
(4) Rhaid i'r person sy'n gyfrifol dros gynnyrch tramwy y mae paragraff (1) yn gymwys iddo ei storio nes iddo gael ei anfon ymlaen neu ei ddinistrio o dan oruchwyliaeth y milfeddyg swyddogol wrth y safle arolygu ar y ffin y mae'r cynnyrch wedi'i ddychwelyd iddo a hynny yn y man ac o dan yr amodau a gyfarwyddir gan y milfeddyg swyddogol.
(5) Rhaid i'r person sy'n gyfrifol dros gynnyrch tramwy y mae paragraff (1) yn gymwys iddo dalu costau storio, cludo, anfon ymlaen a gwaredu'r cynnyrch hwnnw.
