Cynhyrchion a gludir o dan oruchwyliaeth
37.—(1) Mae'r rheoliad hwn yn gymwys i gynhyrchion y bwriedir eu mewnforio ac y mae'n ofynnol iddynt, o dan unrhyw Gyfarwyddeb, Penderfyniad neu Reoliad a restrir yn Atodlen 1, gael eu cludo o dan oruchwyliaeth milfeddyg o'r safle arolygu ar y ffin lle daethpwyd â hwy gyntaf i'r tiriogaethau perthnasol i'w sefydliad cyrchfan.
(2) Ni chaiff neb symud cynnyrch y mae'r rheoliad hwn yn gymwys iddo o safle arolygu ar y ffin oni bai ei fod wedi'i gynnwys mewn cynhwysydd sy'n ddiogel rhag gollyngiadau neu gyfrwng cludo sydd wedi'i selio gan swyddog Cyllid a Thollau neu gan y milfeddyg swyddogol wrth y safle arolygu hwnnw ar y ffin.
(3) Rhaid i'r person sy'n gyfrifol am gynnyrch y mae'r rheoliad hwn yn gymwys iddo ac unrhyw gludydd y mae o dan ei ofal am y tro sicrhau bod y cynnyrch yn cael ei gludo'n ddi-oed i'w sefydliad cyrchfan, a bod y ddogfen fynediad filfeddygol gyffredin yn mynd gydag ef hyd nes iddo gyrraedd ei sefydliad cyrchfan.
(4) Pan fo Rhan 2 o'r ddogfen fynediad filfeddygol gyffredin wedi awdurdodi mewnforio cynnyrch y mae'r rheoliad hwn yn gymwys iddo at ddibenion penodol a ddisgrifiwyd yn rheoliad 36(2)(b) rhaid i'r person sy'n gyfrifol am y cynnyrch ac unrhyw gludydd sydd â gofal drosto am y tro sicrhau ei fod yn aros o dan oruchwyliaeth y Comisiynwyr yn unol â'r weithdrefn T5 y darperir ar ei chyfer yn Erthyglau 471 i 495 o Reoliad y Comisiwn (EEC) Rhif 2454/93 (sy'n gosod darpariaethau ar gyfer gweithredu Rheoliad y Cyngor (EEC) Rhif 2913/92 yn sefydlu'r Cod Tollau Cymunedol)(1) hyd nes iddo gyrraedd ei sefydliad cyrchfan.
(5) Rhaid i weithredydd sefydliad cyrchfan roi hysbysiad ysgrifenedig ar unwaith i'r milfeddyg, sy'n gyfrifol ar ran y Cynulliad Cenedlaethol neu'r Asiantaeth am y sefydliad cyrchfan, fod unrhyw gynnyrch y mae'r rheoliad hwn yn gymwys iddo wedi cyrraedd yno.
(6) Rhaid i weithredydd sefydliad cyrchfan sicrhau bod cynnyrch y mae'r rheoliad hwn yn gymwys iddo yn cael, yn y sefydliad cyrchfan, y driniaeth a ragnodir ar ei gyfer gan y Gyfarwyddeb berthnasol, y Penderfyniad perthnasol neu'r Rheoliad perthnasol a restrir yn Atodlen 1.
