The Welsh Ministers are designated1 for the purposes of section 2(2) of the European Communities Act 19722 in relation to the quality of water intended for domestic purposes or for use in a food production undertaking

These Regulations make provision for a purpose mentioned in that section and it appears to the Welsh Ministers that it is expedient for the reference to Council Directive 89/106/EEC on the approximation of laws, regulations and administrative provisions of the Member States relating to construction products3 and to Directive 98/34/EC of the European Parliament and of the Council laying down a procedure for the provision of information in the field of technical standards and regulations and of rules on Information Society Services4 to be construed as references to those instruments as amended from time to time

The Welsh Ministers make regulation 2(20)(a) and (b) and (21) in exercise of the powers conferred by section 2(2) of the European Communities Act 1972 (as read with paragraph 1A of Schedule 2 to that Act5), regulation 5 in exercise of the powers conferred by section 39 of the National Health Service Reform and Health Care Professions Act 20026, regulation 6 in exercise of the powers conferred by section 103 of the Water Act 20037, and all other provisions in these Regulations in exercise of the powers conferred by sections 67, 69, 77(3) and (4) and 213(2) of the Water Industry Act 19918:
