Rheoliadau Rheolaethau Swyddogol ar Fwyd Anifeiliaid a Bwyd (Cymru) 2007

Pwer i ofyn am wybodaeth sy'n ymwneud â chamau gorfodi

8.—(1) At ddibenion cyflawni ei swyddogaeth o dan reoliad 7 mewn perthynas ag unrhyw awdurdod gorfodi, caiff yr Asiantaeth ei gwneud yn ofynnol i berson a grybwyllir ym mharagraff (2) —

(a)darparu i'r Asiantaeth unrhyw wybodaeth y mae ganddi sail resymol dros gredu y gall y person hwnnw ei rhoi; neu

(b)rhoi ar gael i'r Asiantaeth eu harolygu unrhyw gofnodion y mae ganddi sail resymol dros gredu eu bod yn cael eu dal gan y person hwnnw neu eu bod o fewn ei reolaeth mewn ffordd arall (ac os ydynt yn cael eu cadw ar ffurf gyfrifiadurol eu rhoi ar gael ar ffurf ddarllenadwy).

(2) Gall gofyniad o dan baragraff (1) gael ei osod—

(a)ar yr awdurdod gorfodi neu ar unrhyw aelod o'r awdurdod, unrhyw swyddog i'r awdurdod neu ar un o gyflogeion yr awdurdod; neu

(b)ar berson sy'n ddarostyngedig i unrhyw ddyletswydd o dan ddeddfwriaeth archwilio berthnasol (a honno'n ddyletswydd y gellir ei gorfodi gan awdurdod gorfodi) neu unrhyw swyddog i'r person hwnnw neu unrhyw un o'i gyflogeion.

(3) Caiff yr Asiantaeth gopïo unrhyw gofnodion a roddir ar gael iddi yn unol â gofyniad o dan baragraff (1)(b).
