RHAN 2Gofynion Cyffredinol ar gyfer Deunyddiau ac Eitemau

Gorfodi Rheoliad 1935/2004

4.  Yn ddarostyngedig i ddarpariaethau Erthygl 27 (trefniadau trosiannol), bydd unrhyw berson sydd yn torri unrhyw un o'r darpariaethau canlynol o Reoliad 1935/2004 yn euog o drosedd —

(a)Erthygl 3 (gofynion cyffredinol);

(b)Erthygl 4 (gofynion arbennig ar gyfer deunyddiau ac eitemau gweithredol a deallus);

(c)Erthygl 11(4) a (5) (darpariaethau o ran awdurdodiad y Gymuned);

(ch)Erthygl 15(1), (2), (3), (4), (7) ac (8) (labelu);

(d)Erthygl 16(1) (datganiad o gydymffurfiad);

(dd)Erthygl 17(2) (y gallu i olrhain).

5.  Mae unrhyw berson sydd yn methu â chydymffurfio â gofynion Erthygl 4 (cydymffurfiad ag arfer gweithgynhyrchu da) o Reoliad 2023/2006 yn euog o drosedd.

Awdurdodau cymwys at ddibenion Rheoliad 1935/2004

6.  Y cyrff canlynol sydd wedi eu dynodi'n awdurdodau cymwys at ddibenion darpariaethau Rheoliad 1935/2004, fel y nodir isod —

(a)mewn cysylltiad ag Erthyglau 9 a 13, yr Asiantaeth Safonau Bwyd;

(b)mewn cysylltiad ag Erthyglau 16(1) a 17(2), yr Asiantaeth Safonau Bwyd a'r awdurdod sydd â chyfrifoldeb am orfodi yn unol â rheoliad 14(1).

7.  Yr awdurdod cymwys at ddibenion Erthygl 6(2) a 7(3) o Reoliad 2023/2006 yw pob awdurdod bwyd oddi mewn i'w ardal.
