Amddiffyniadau

21.—(1) Mewn unrhyw achosion o dramgwydd o dan y Rheoliadau hyn mae'n amddiffyniad i'r cyhuddedig ddangos—

(a)bod y dŵr wedi'i botelu a'i farcio neu wedi'i labelu cyn i'r Rheoliadau hyn ddod i rym; a

(b)na fyddai unrhyw dramgwydd wedi'i gyflawni gan y cyhuddedig o dan Reoliadau Dŵr Mwynol Naturiol, Dŵr Ffynnon a Dŵr Yfed wedi'i Botelu 1999.

(2) Mewn unrhyw achosion am dramgwydd o dan y Rheoliadau hyn os honnir nad yw dŵr yn bodloni'r gofynion ym mharagraff 1(c) o Ran 1 o Atodlen 2, mae'n amddiffyniad i'r person a gyhuddir ddangos—

(a)bod y dŵr o dan sylw wedi'i botelu neu'i werthu mewn Gwladwriaeth AEE heblaw'r Deyrnas Unedig; a

(b)bod y dŵr yn cydymffurfio â'r gyfraith yn y Wladwriaeth AEE honno pan gafodd ei botelu neu'i werthu.
