Title, commencement and interpretation

1.—(1) The title of these Regulations is the Children’s Commissioner for Wales (Amendment) Regulations 2007 and they come into force on 9 February 2007.

(2) These Regulations apply in relation to Wales.

2.—(1) In these Regulations—

“the Act” (“y Ddeddf”) means the Care Standards Act 2000.

“the Commissioner” (“the Commissioner”) means the Children’s Commissioner for Wales.

“the initial period” (“y cyfnod cychwynnol”) means the initial period as defined in section 161(5) of the Government of Wales Act 2006.

Amendments to the Children’s Commissioner for Wales Regulations 2001

3.—(1) The Children’s Commissioner for Wales Regulations 2001(2) are amended in accordance with the following provision of this regulation.

(2) Following the expiry of the initial period, for the definition of “the First Minister” (“y Prif Weinidog”), substitute the following definition:—

“the First Minister” (“y Prif Weinidog”) means the person appointed from time to time as the First Minister for Wales under section 46(1) of the Government of Wales Act 2006.

(3) Amend regulation 13 as follows —

(a)After regulation 13(2), add—

(2A) Where the Commissioner and the Commissioner for Older People in Wales discharge their respective functions under the Act and the Commissioner for Older People (Wales) Act 2006(3), in relation to the same matter the Commissioner may make a joint report with the Commissioner for Older People in Wales.

(b)In regulation 13(3), for “(1) or (2)” substitute “(1), (2) or (2A).”

Explanatory Note

(This note is not part of the Regulations)

These Regulations amend Part VI of the Children’s Commissioner for Wales Regulations 2001 which make provision in relation to the functions of the Children’s Commissioner for Wales (“the Commissioner”).

Part VI of the Children’s Commissioner for Wales Regulations 2001 makes provision for specific reports to be made by the Commissioner.

Part VI is amended in order to provide that where the Commissioner and the Commissioner for Older People in Wales discharge their functions in relation to the same matter, the Commissioner may make a joint report with the Commissioner for Older People in Wales. A similar provision applies in the Commissioner for Older People in Wales regulations 2007.

In addition, these Regulations provide that the definition of First Minister in the Regulations is amended after the initial period specified in the Government of Wales Act 2006, so as to define the First Minister as the First Minister appointed under section 46(1) of the Government of Wales Act 2006.

A Regulatory Appraisal as to the effect these regulations might have on business costs have been prepared pursuant to s.65 of the Government of Wales Act 1998 in relation to these regulations, and placed in the library of the National Assembly for Wales.
