Mae Gweinidogion Cymru yn gwneud y Rheoliadau hyn drwy arfer y pwerau a freiniwyd ynddynt(1) gan adran 19(1) o Ddeddf Cofrestru Tiroedd Comin 1965(2):

O ran Cymru, cafodd swyddogaethau'r Gweinidog eu trosglwyddo i Ysgrifennydd Gwladol Cymru gan Orchymyn y Weinyddiaeth Tir ac Adnoddau Naturiol (Diddymu) 1967 (O.S. 1967/156). Trosglwyddwyd swyddogaethau Ysgrifennydd Gwladol Cymru i Gynulliad Cenedlaethol Cymru gan Orchymyn Cynulliad Cenedlaethol Cymru (Trosglwyddo Swyddogaethau) 1999 (O.S. 1999/672) ac maent bellach yn arferadwy gan Weinidogion Cymru yn rhinwedd adran 162 o Ddeddf Llywodraeth Cymru 2006 (p.32), a pharagraff 30 o Atodlen 11 iddi.
