Coming into force

The Welsh Ministers are designated for the purposes of section 2(2) of the European Communities Act 19721 in relation to the common agricultural policy of the European Community2 and in relation to measures relating to food (including drink) including the primary production of food3.

There has been open and transparent public consultation during the preparation of the following Regulations as required by Article 9 of Regulation (EC) No. 178/2002 of the European Parliament and of the Council4 laying down the general principles and requirements of food law, establishing the European Food Safety Authority and laying down procedures in matters of food safety.

The Welsh Ministers make the following Regulations under the powers conferred by section 2(2) of the European Communities Act 1972:

Title, commencement and interpretation1

The title of these Regulations is the Common Agricultural Policy (Wine) (Wales) (Amendment) Regulations 2007 and they come into force on 4 September 2007.

In these Regulations “the 2001 Regulations” (“Rheoliadau 2001”) means the Common Agricultural Policy (Wine) (Wales) Regulations 20015.

These Regulations apply in relation to Wales.

Amendment of the 2001 Regulations2

The 2001 Regulations are amended as follows.

In regulation 2(1), replace the definitions of “Commission Regulation (EC) No. 1622/2000”, “Commission Regulation (EC) No. 1623/2000”, “Commission Regulation (EC) No. 883/2001”, “Commission Regulation (EC) No. 884/2001”, “Commission Regulation (EC) No. 753/2002” and “Council Regulation (EC) No. 1493/19996 with the following definitions—

  • “Commission Regulation (EC) No. 1622/2000” (“Rheoliad y Comisiwn (EC) Rhif 1622/2000”) means Commission Regulation (EC) No. 1622/20007 laying down certain detailed rules for implementing Regulation (EC) No. 1493/1999 on the common organisation of the market in wine and establishing a Community code on oenological practices and processes, and references in Schedules 2 and 5 to “Regulation 1622/2000” must be construed accordingly;

  • “Commission Regulation (EC) No. 1623/2000” (“Rheoliad y Comisiwn (EC) Rhif 1623/2000”) means Commission Regulation (EC) No. 1623/20008 laying down detailed rules for implementing Regulation (EC) No. 1493/1999 on the common organisation of the market in wine with regard to market mechanisms, and the reference in Part I of Schedule 2 to “Regulation 1623/2000” must be construed accordingly;

  • “Commission Regulation (EC) No. 883/2001” (“Rheoliad y Comisiwn (EC) Rhif 883/2001”) means Commission Regulation (EC) No. 883/20019 laying down detailed rules for implementing Council Regulation (EC) No. 1493/1999 as regards trade with third countries in products in the wine sector, and the reference in Part V of Schedule 2 to “Regulation 883/2001” must be construed accordingly;

  • “Commission Regulation (EC) No. 884/2001” (“Rheoliad y Comisiwn (EC) Rhif 884/2001”) means Commission Regulation (EC) No. 884/200110 laying down detailed rules of application concerning the documents accompanying the carriage of wine products and the records to be kept in the wine sector, and the reference in Part I of Schedule 2 to “Regulation 884/2001” must be construed accordingly;

  • “Council Regulation (EC) No. 1493/1999” means Council Regulation (EC) No. 1493/199912 on the common organisation of the market in wine, and references in Schedules 2 and 5 to “Regulation 1493/1999” must be construed accordingly;

These Regulations amend the Common Agricultural Policy (Wine) (Wales) Regulations 2001 (S.I.2001/2193 (W.155)), which provide for the enforcement in Wales of European Community legislation concerned with the production and marketing of wine and related products.

These Regulations—

a

update references to European Community legislation by making changes to the definitions in the 2001 Regulations (regulation 2(2)) and inserting a new Schedule 1 into the 2001 Regulations (regulation 2(3) and the Schedule);

b

add Acolon, Cabernet Sauvignon, Frühburgunder (with the synonym Pinot Noir Précoce) and Merlot to the list of vine varieties that may be used in the production of wines in Wales (regulation 2(4));

c

make minor changes to the analytical tests for quality wine psr by removing the total sugar-free dry extract test and standard (regulation 2(5)(a)) and removing the minimum standard relating to free sulphur dioxide (regulation 2(5)(b)); and

d

make a minor change to the analytical tests for table wines with a geographical indication by removing the total dry extract test and standard (regulation 2(6)).
