Gorchymyn Lles Anifeiliaid (Cludo) (Cymru) 2007

22.—(1) Caiff y Cynulliad Cenedlaethol, drwy hysbysiad, atal neu ddiwygio cymeradwyaeth, awdurdodiad, tystysgrif gymeradwyaeth neu dystysgrif hyfedredd os yw wedi'i fodloni bod unrhyw un o'r amodau y cafodd y gymeradwyaeth neu'r dystysgrif ei rhoi odano neu y cafodd yr awdurdodiad ei roi odano wedi'i dorri neu fod unrhyw ddarpariaeth yn Rheoliad y Cyngor (EC) Rhif 1/2005, Rheoliad y Cyngor (EC) Rhif 1255/97 neu'r Gorchymyn hwn wedi'i thorri.

(2) O ran ataliad o dan baragraff (1)—

(a)mae'n effeithiol ar unwaith pan fo'r Cynulliad Cenedlaethol o'r farn ei fod yn angenrheidiol i ddiogelu lles yr anifeiliaid;

(b)ni fydd yn effeithiol fel arall am o leiaf 21 o ddiwrnodau ar ôl cyflwyno'r hysbysiad.

(3) Yn yr hysbysiad rhaid—

(a)rhoi rhesymau;

(b)datgan pryd y daw ei effaith i rym ac, yn achos ataliad, datgan ar ba ddyddiad neu adeg pa ddigwyddiad y mae ei effaith i ddod i ben; ac

(c)esbonio hawl derbynnydd yr hysbysiad i gyflwyno sylwadau ysgrifenedig i berson a benodir gan y Cynulliad Cenedlaethol.

(4) Pan na fo'r hysbysiad yn effeithiol ar unwaith, a bod sylwadau yn cael eu cyflwyno o dan erthygl 23, ni fydd diwygiad neu ataliad yn effeithiol tan y penderfyniad terfynol gan y Cynulliad Cenedlaethol yn unol ag erthygl 23 oni fydd y Cynulliad Cenedlaethol yn penderfynu ei bod yn angenrheidiol er mwyn diogelu lles anifeiliaid i'r diwygiad neu'r ataliad fod yn effeithiol ar unwaith a'i fod yn rhoi hysbysiad i'r perwyl hwnnw.

(5) Pan gaiff ataliad ei gadarnhau, caiff y Cynulliad Cenedlaethol, drwy hysbysiad, ddirymu cymeradwyaeth, awdurdodiad, tystysgrif gymeradwyaeth neu dystysgrif hyfedredd os caiff ei fodloni na chydymffurfir â'r Gorchymyn hwn, Rheoliad y Cyngor (EC) Rhif 1/2005 na Rheoliad y Cyngor (EC) Rhif 1255/97.

(6) Rhaid peidio â dyroddi hysbysiad o dan baragraff (5) hyd oni fydd y broses yn erthygl 23 (os bydd un) wedi'i chwblhau.
