Rheoliadau Anffurfio (Triniaethau a Ganiateir) (Cymru) 2007

Yn ôl adrannau 5 (1) a (2) o Ddeddf Lles Anifeiliaid 2006 (p.45) (“y Ddeddf”) tramgwydd yw gwneud y canlynol i anfeiliaid sy'n cael eu gwarchod o dan y Ddeddf honno:

(a)rhoi triniaeth waharddedig;

(b)peri rhoi triniaeth waharddedig; neu

(c)o dan amgylchiadau penodedig, ganiatáu i berson arall roi triniaeth waharddedig.

Ystyr “rhoi triniaeth waharddedig” yw gwneud rhywbeth sy'n cynnwys ymyrryd â meinweoedd sensitif (e.e. croen) neu strwythur esgyrn yr anifail heblaw at ei drin yn feddygol (gweler adran 5(3) o'r Ddeddf).

Mae'r Rheoliadau hyn yn pennu'r triniaethau nad ydynt yn dramgwyddau yn ôl adran 5(1) a 5(2). Gan ddibynnu ar yr anifeiliaid y mae'r triniaethau i'w rhoi iddynt, caiff y triniaethau hynny gynnwys triniaethau at:

(a)adnabod yr anifeiliaid (fel tagiau clust);

(b)rheoli atghenhedlu (fel ysbaddu, cyweirio neu dorri ar anifail, a fasdoriad (hynny yw, fasectomi)); ac

(c)triniaethau at ddibenion eraill (fel laparosgopi) (Atodlen 1).

Am rai o'r triniaethau hyn, ac unwaith eto gan ddibynnu ar yr anifeiliaid y mae caniatâd i'w rhoi iddynt, mae Atodlenni 2 i 9 yn gosod cyfyngiadau ar roi'r driniaeth (fel pennu oedran y mae'n rhaid i'r anifail fod ynddo, neu bennu bod rhaid rhoi anesthetig).

O ran triniaethau penodol y caniateir eu rhoi i foch, mae'r Rheoliadau hyn yn gweithredu paragraff 8 o Bennod I o'r Atodiad i Gyfarwyddeb y Cyngor 91/630/EEC sy'n gosod y safonau gofynnol ar gyfer gwarchod moch (OJ Rhif L340, 11.12.1991, t.33), fel y'i diwygiwyd gan Gyfarwyddeb y Cyngor 2001/88/EC, OJ Rhif L316, 1.12.2001, t.1), Cyfarwyddeb y Comisiwn 2001/93/EC (OJ Rhif L316, 1.12.2001, t.36) a Rheoliad y Cyngor (EC) Rhif 806/2003 (OJ Rhif L122, 16.5.2003, t.1). O ran tocio pig ieir dodwy, mae'r Rheoliadau hyn yn gweithredu paragraff 8 o'r Atodiad i Gyfarwyddeb y Cyngor 1999/74/EC sy'n gosod y safonau gofynnol ar gyfer gwarchod ieir dodwy (OJ Rhif L203, 3.8.1999, p.53, fel y'i diwygiwyd ddiwethaf gan Reoliad y Cyngor (EC) Rhif 806/2003 (OJ Rhif L122, 16.5.2003, t.1).
