Monitro camau gorfodi

7.—(1) Un o swyddogaethau'r Asiantaeth yw monitro perfformiad awdurodau gorfodi o ran gorfodi rheoliadau archwilio penodol.

(2) Mae'r swyddogaeth honno yn cynnwys, yn benodol, gosod safonau perfformiad (boed ar gyfer awdurdodau gorfodi yn gyffredinol neu ar gyfer awdurdodau penodol) mewn perthynas â gorfodi unrhyw ddeddfwriaeth archwilio berthnasol.

(3) Rhaid i bob adroddiad blynyddol yr Asiantaeth gynnwys adroddiad ar ei gweithgareddau yn ystod y flwyddyn i orfodi unrhyw ddeddfwriaeth archwilio berthnasol y mae'n awdurdod gorfodi ar ei chyfer ac ar ei pherfformiad o ran—

(a)unrhyw safonau o dan baragraff (2) sy'n gymwys i'r gweithgareddau hynny; a

(b)unrhyw amcanion sy'n ymwneud â'r gweithgareddau hynny a bennir yn y datganiad o amcanion ac arferion o dan adran 22 o Ddeddf Safonau Bwyd 1999(1).

(4) Caiff yr Asiantaeth gyflwyno adroddiad i unrhyw awdurdod gorfodi arall ar ei berfformiad o ran gorfodi unrhyw ddeddfwriaeth archwilio berthnasol a chaniateir i'r adroddiad hwnnw gynnwys canllawiau ynghylch y camau y cred yr Asiantaeth y byddent yn gwella'r perfformiad hwnnw.

(5) Caiff yr Asiantaeth gyfarwyddo awdurdod y mae adroddiad o'r fath wedi'i gyflwyno iddo—

(a)i drefnu i gyhoeddi'r adroddiad, neu wybodaeth benodedig sy'n ymwneud â'r adroddiad, yn y modd a bennir yn y cyfarwyddyd; a

(b)i hysbysu'r Asiantaeth, o fewn y cyfnod a bennir felly, o ba gamau y mae wedi'u cymryd neu'n bwriadu eu cymryd mewn ymateb i'r adroddiad.

(6) Mae adran 19 o Ddeddf Safonau Bwyd 1999 yn gymwys o ran gwybodaeth a gafwyd drwy fonitro o dan y rheoliad hwn fel petai'n wybodaeth a gafwyd drwy fonitro o dan adran 12 o'r Ddeddf honno.
