Ystyr “awdurdod gorfodi” ac ymadroddion cysylltiedig
10.—(1) Yn rheoliadau 7 i 9 ystyr “deddfwriaeth archwilio berthnasol” yw cyfraith bwyd anifeiliaid berthnasol a chyfraith bwyd berthnasol y mae'r Asiantaeth wedi'i dynodi'n awdurdod cymwys ar eu cyfer yn unol â pharagraffau (1) a (3) o reoliad 3 yn y drefn honno ond nid yw'n cynnwys deddfwriaeth berthnasol fel y diffinnir “relevant legislation” yn adran 15 o Ddeddf Safonau Bwyd 1999.
(2) Yn rheoliadau 7 i 9 ystyr “awdurdod gorfodi” yw'r awdurdod y mae deddfwriaeth archwilio berthnasol i'w gorfodi drwyddo ac mae'n cynnwys yr Asiantaeth ei hun os yr awdurdod gorfodi ydyw mewn perthynas â hi ond nid yw'n cynnwys y Comisiwn Ewropeaidd; ac mae “gorfodi” o ran deddfwriaeth archwilio berthnasol yn cynnwys gweithredu unrhyw ddarpariaethau yn y ddeddfwriaeth honno.
(3) Mae unrhyw gyfeiriad yn rheoliadau 7 i 9 (sut bynnag y mae wedi'i fynegi) at berfformiad awdurdod gorfodi o ran gorfodi unrhyw ddeddfwriaeth archwilio berthnasol yn cynnwys cyfeiriad at allu'r awdurdod hwnnw i'w gorfodi.
