(This note is not part of the Regulations)

These Regulations amend the Children (Secure Accommodation) Regulations 19914 by revoking regulation 3 of those Regulations so far as it applies in Wales. This regulation provides that accomodation in a children’s home in Wales is not to be used as secure accomodation unless it has been approved by the National Assembly for Wales for such use. The function of approving children’s secure accomodation is exercisable by the Secretary of State and was transferred to the National Assembly for Wales in 19995.
