The Specified Diseases (Notification and Slaughter) (Wales) Order 2006

The National Assembly for Wales makes the following Order in exercise of the powers conferred by sections 15(4), 32(2) and 88(2) of the Animal Health Act 1981(1) and now vested in it:

Title, commencement and application

1.—(1) The title of this Order is the Specified Diseases (Notification and Slaughter) (Wales) Order 2006.

(2) This Order comes into force on 29 August 2006.

(3) This Order applies in relation to Wales.

Amendment of the Specified Diseases (Notification and Slaughter) Order 1992

2.  In article 2(1) (application of section 32 of the Animal Health Act 1981) of the Specified Diseases (Notification and Slaughter) Order 1992(2) after “Epizootic haemorrhagic virus disease” insert “Equine infectious anaemia”.

Amendment of the Specified Diseases (Notification) Order 1996

3.  In Part I of Schedule 1 (specified diseases) to the Specified Diseases (Notification) Order 1996(3) after “Epizootic haemorrhagic virus disease” insert “Equine infectious anaemia”.

Explanatory Note

(This note is not part of the Order)

Article 2 of this Order amends the Specified Diseases (Notification and Slaughter) Order 1992 (S.I. 1992/3159) by adding equine infectious anaemia to the list of diseases to which section 32 of the Animal Health Act 1981 applies (under which the National Assembly for Wales may cause animals to be slaughtered).

Article 3 amends the Specified Diseases (Notification) Order 1996 (S.I. 1996/2628) by adding equine infectious anaemia to the list of specified diseases in relation to which the notification provisions in article 3 of that Order apply.

1981 c. 22, as amended by the Animal Health Act 2002 (c. 42), and S.I. 2003/1734. Powers of the Secretary of State for Wales were, so far as exercisable in relation to Wales, transferred to the National Assembly for Wales (“the National Assembly”) by virtue of S.I. 1999/672. The functions of the Secretary of State for Scotland were transferred to the Minister of Agriculture, Fisheries and Food by S.I. 1999/3141 and were then transferred to the Secretary of State by S.I. 2002/794. The functions of the Secretary of State were, in so far as exercisable to Wales, transferred to the National Assembly by S.I. 2004/3044.
