Atal safleoedd arolygu ar y ffin rhag gweithredu
13.—(1) Os yw Cynulliad Cenedlaethol Cymru wedi'i fodloni—
(a)y byddai parhau i weithredu safle arolygu ar y ffin yn peri risg difrifol i iechyd y cyhoedd neu i iechyd anifeiliaid; neu
(b)bod toriad difrifol wedi bod, wrth safle arolygu ar y ffin, o'r gofynion ar gyfer cymeradwyo safleoedd arolygu ar y ffin sydd wedi'u gosod yn Atodiad II i Gyfarwyddeb 97/78/EC neu ym Mhenderfyniad y Comisiwn 2001/812/EC (sy'n gosod gofynion ar gyfer cymeradwyo safleoedd arolygu ar y ffin sy'n gyfrifol am wiriadau milfeddygol ar gynhyrchion sy'n cael eu cyflwyno i'r Gymuned o drydydd gwledydd)(1),
caiff gyflwyno i weithredydd y safle arolygu ar y ffin o dan sylw hysbysiad ysgrifenedig yn datgan bod y gymeradwyaeth o'r fangre fel safle arolygu ar y ffin yn unol ag Erthygl 6(2) neu 6(4) o Gyfarwyddeb 97/78/EC wedi'i hatal.
(2) Ar ôl cyflwyno hysbysiad yn unol â pharagraff (1), rhaid i'r fangre bellach beidio â bod yn safle arolygu ar y ffin, er gwaethaf y ffaith y gall ymddangos o hyd ar y rhestr o safleoedd arolygu ar y ffin sydd wedi'i chynnwys yn yr Atodiad i Benderfyniad y Comisiwn 2001/881/EC, nes iddi gael ei chymeradwyo unwaith eto fel safle arolygu ar y ffin yn unol ag Erthygl 6(2)(a) o Gyfarwyddeb 97/78/EC.
