Atal neu adennill iawndal
37.—(1) Lle —
(a)mae cynhyrchwr wedi cyflwyno cais am iawndal yn unol â chynllun iawndal y Gymuned; a
(b)yr ymddengys i'r Cynulliad Cenedlaethol i'r cynhyrchwr —
(i)wneud datganiad ffug neu gamarweiniol yn ei gais/chais, neu
(ii)methu â chydymffurfio ag unrhyw un o ofynion y cynllun,
caiff y Cynulliad Cenedlaethol atal neu adennill ar orchymyn oddi wrth y cynhyrchwr hwnnw y cyfan o'r iawndal neu unrhyw ran ohono sy'n daladwy neu a dalwyd iddo neu iddi.
(2) Yn y rheoliad hwn, ystyr “cynllun iawndal y Gymuned” yw'r cynllun a sefydlwyd yn Rheoliad y Cyngor (EC) Rhif 2330/98 yn darparu ar gyfer cynnig iawndal i rai cynhyrchwyr llaeth a chynhyrchion llaeth y cyfyngir arnynt dros dro rhag cynnal eu busnes(1) a Rheoliad y Comisiwn (EC) Rhif 2647/98 yn gosod rheolau manwl ar gyfer cymhwyso Rheoliad y Cyngor (EC) Rhif 2330/98(2).
