Hawliau a rhwymedigaethau o dan gontract cyflogaeth
47. Heb ragfarnu cyffredinolrwydd rheoliad 46, os yw'r rheoliad hwnnw'n peri bod hawliau a rhwymedigaethau yn cael eu trosglwyddo o dan gontract cyflogaeth—
(a)bydd y contract yn effeithiol o'r dyddiad ymgorffori fel pe bai wedi'i wneud yn wreiddiol rhwng y cyflogai a'r corff llywodraethu sydd wedi'i gyfansoddi o dan yr offeryn llywodraethu, a
(b)heb ragfarnu paragraff (a), bernir o'r dyddiad hwnnw ymlaen fod unrhyw beth a wnaed cyn y dyddiad hwnnw gan neu mewn perthynas â'r corff llywodraethu dros dro mewn perthynas â'r contract hwnnw neu'r cyflogai wedi'i wneud gan neu mewn perthynas â'r corff llywodraethu sydd wedi'i gyfansoddi o dan yr offeryn llywodraethu,
ond ni fydd unrhyw hawl i'r cyflogai derfynu ei gontract cyflogaeth os caiff newid sylweddol ei wneud ar ei draul yn ei amodau gwaith yn codi dim ond oherwydd y newid cyflogwr sydd wedi'i beri gan y rheoliad hwnnw.
