Gweithfeydd gwyro a wneir gan ymgymerwr oherwydd gweithfeydd pwysig awdurdod

3.—(1) Lle mae ymgymerwr(1) yn gwneud gweithfeydd gwyro, oherwydd gweithfeydd pwysig a gychwynnir gan awdurdod, rhaid i'r awdurdod dalu i'r ymgymerwr —

(a)lle mae'r gweithfeydd pwysig yn weithfeydd trafnidiaeth (heblaw gweithfeydd pontydd pwysig neu weithfeydd adran 86(3) (a) i (g)) a lle rhoddir taliad yn unol â rheoliad 8(1), swm sy'n gyfartal i 92.5 y cant o gostau a ganiateir y gweithfeydd gwyro;

(b)mewn achosion eraill lle rhoddir taliad yn unol â rheoliad 8(1), swm sy'n gyfartal i 82 y cant o gostau a ganiateir y gweithfeydd gwyro;

(c)ym mhob achos arall, costau a ganiateir y gweithfeydd gwyro.

(2) Mae'r rheoliad hwn yn ddarostyngedig i reoliad 6.

Mae i “ymgymerwr” yr ystyr a ragnodir i “undertaker” yn adran 48 o'r Ddeddf.
