Cwynion

19.—(1) Rhaid i'r person cofrestredig sefydlu gweithdrefn ysgrifenedig (y cyfeirir ati yn y Rheoliadau hyn fel “y weithdrefn gwynion”) ar gyfer ystyried cwynion a wneir gan neu ar ran unrhyw berson sydd wedi gofyn am wasanaethau cymorth mabwysiadu, neu y mae'r asiantaeth wedi'u darparu iddynt.

(2) Yn benodol, rhaid i'r weithdrefn gwynion ddarparu —

(a)cyfle i ddatrys cwyn yn gynnar drwy ddull anffurfiol;

(b)na chaiff unrhyw berson sy'n wrthrych cwyn gymryd rhan yn y broses o'i hystyried ac eithrio, os bydd y person cofrestredig yn barnu bod hynny'n briodol, yn ystod cyfnod datrys y gwyn yn anffurfiol yn unig;

(c)ar gyfer ymdrin â chwynion am y person cofrestredig; ac

(ch)yn achos asiantaeth sy'n darparu gwasanaethau cymorth mabwysiadu i blant, bod cwynion i'w gwneud gan berson sy'n gweithredu ar ran plentyn.

(3) Rhaid i'r person cofrestredig ddarparu copi o'r weithdrefn gwynion i bob person sy'n gweithio at ddibenion yr asiantaeth ac, os gofynnir iddo wneud hynny, rhaid iddo ddarparu copi o'r weithdrefn i unrhyw berson a grybwyllir ym mharagraff (1) neu i unrhyw berson sy'n gweithio ar ran plentyn.

(4) Rhaid i'r copi o'r weithdrefn gwynion a ddarparwyd o dan baragraff (3) gynnwys —

(a)enw, cyfeiriad a Rhif ffôn yr awdurdod cofrestru; a

(b)manylion y weithdrefn (os oes un) yr hysbyswyd y person cofrestredig ohoni gan yr awdurdod cofrestru ar gyfer gwneud cwynion i'r awdurdod cofrestru sy'n ymwneud â'r asiantaeth.
