The National Assembly for Wales, in exercise of the powers conferred upon it by sections 112 and 210 of the Education Act 2002(1), and having made such arrangements for consultation about the proposals as it considers appropriate in accordance with section 117 of the said Act, hereby makes the following Regulations:

Title, commencement and applicationE+W

1.  The title of these Regulations is the Education (Disapplication of the National Curriculum at Key Stage 1) (Wales) Regulations 2005 and they come into force on 1 July 2005.

InterpretationE+W

3.  In these Regulations —

“the 2002 Act” (“Deddf 2002”) means the Education Act 2002;

“desirable outcomes” (“canlyniadau dymunol”) has the meaning given to it by section 104 of the 2002 Act;

“educational programmes” (“rhaglenni addysgol”) has the meaning given to it by section 104 of the 2002 Act;

“first key stage” (“cyfnod allweddol cyntaf”) is to be construed in accordance with section 103(1) of the 2002 Act;

“foundation phase pilot” (“cynllun treialu'r cyfnod sylfaen”) means a pilot funded by the National Assembly for Wales for the purpose of testing or developing the areas of learning, desirable outcomes, educational programmes and assessment arrangements prior to the commencement of section 102 of the 2002 Act;

“maintained school” (“ysgol a gynhelir”) has the meaning given to it in section 97 of the 2002 Act;

“registered pupil” (“disgybl cofrestredig”) means a person registered as a pupil at a school in the register kept under section 434 of the Education Act 1996(2).

Disapplication of the National Curriculum at Key Stage 1E+W

4.  The provisions of the National Curriculum for Wales are not to apply in relation to a registered pupil at the first key stage at a maintained school where that pupil is participating in the foundation phase pilot.

Explanatory Note

(This note is not part of the Regulations)

These Regulations made under the Education Act 2002 provide for the disapplication of the National Curriculum for Wales for pupils at maintained schools who are at the first key stage and who are participating in the foundation stage (known in Wales as the foundation phase) pilot.
