The Non-Domestic Rating Contributions (Wales) (Amendment) Regulations 2004

The National Assembly for Wales, in exercise of the powers conferred upon it by sections 140(4) and 143(1) and (2) of, and paragraphs 4 and 6 of Schedule 8 to, the Local Government Finance Act 19881, hereby make the following Regulations:

Name, commencement and application1

These Regulations are called the Non-Domestic Rating Contributions (Wales) (Amendment) Regulations 2004 and come into force on 31 December 2004.

These Regulations apply in relation to Wales.

Interpretation2

In these Regulations “the 1992 Regulations” (“Rheoliadau 1992”) means the Non-Domestic Rating Contributions (Wales) Regulations 19922.

Amendment of the 1992 Regulations3

In relation to financial years beginning on or after 1 April 2005, Schedules 2 and 4 to the 1992 Regulations are amended as follows:—

a

in paragraph 2(12) of Schedule 2 for “0.998” there is substituted “1.009”; and

b

for Schedule 4 to the 1992 Regulations there is substituted the Schedule set out in the Schedule to these Regulations.

Under Part II of Schedule 8 to the Local Government Finance Act 19884, billing authorities in Wales are required to pay amounts (called non-domestic rating contributions) to the National Assembly for Wales. Rules for the calculation of those amounts are contained in the Non-Domestic Rating Contributions (Wales) Regulations 19925 (“the 1992 Regulations”).

These Regulations amend the 1992 Regulations by substituting a new multiplier in paragraph 2(12) of Schedule 2 (Assumptions as to gross amount) and a new Schedule 4 (Adult Population Figures).
