Disgyblion nad ydynt yn ddarostyngedig i ddarpariaethau'r Cwricwlwm Cenedlaethol

6.—(1) Mae erthygl 5 i fod yn effeithiol mewn perthynas â disgyblion nad yw darpariaethau'r Cwricwlwm Cenedlaethol yn gymwys mewn perthynas â hwy (gan gynnwys disgyblion â datganiad anghenion addysgol arbennig) gyda'r addasiadau a bennir yn yr erthygl hon.

(2) Os, yn achos unrhyw bwnc perthansol, nad yw un TC yn gymwys i un o'r disgyblion hynny, mae erthygl 5 i fod yn effeithiol fel petai nifer y TCau sy'n gymwys i'r disgybl yn gyfanswm y TCau yn y pwnc a'r TC nad yw'n gymwys, ac unrhyw bwysoli yn gysylltiedig ag ef, yn cael ei ddiystyru.

(3) Os, yn achos unrhyw bwnc perthnasol, nad yw rhagor nag un TC yn gymwys i'r disgybl, nid yw erthygl 5 i fod yn gymwys i'r disgybl mewn perthynas â'r pwnc hwnnw ac nid oes lefel cyrhaeddiad i'w benderfynu ar ei gyfer mewn perthynas â'r pwnc hwnnw.
